1. Agreement to Terms

By accessing or using GuestGuide ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all users, including property owners, managers, and guests who access digital guidebooks.

2. Account Registration and Security

2.1 Account Creation

To use certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account

2.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

3. Service Description

GuestGuide provides a digital platform for property owners and managers to create, manage, and share digital guidebooks with their guests. Our services include:

  • Digital guidebook creation and customization tools
  • Upsell and add-on management features
  • AI-powered concierge assistance
  • Analytics and reporting dashboards
  • Payment processing for guest purchases

4. User Obligations and Prohibited Conduct

4.1 Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Platform or servers
  • Use the Platform for fraudulent or deceptive purposes
  • Harass, abuse, or harm other users
  • Scrape, crawl, or use automated tools to access the Platform

4.2 Content Standards

All content you create or upload must be accurate, lawful, and not misleading. You must not include content that is defamatory, obscene, offensive, or violates the rights of others.

5. Payment Terms

5.1 Subscription Fees

Access to certain features requires a paid subscription. By subscribing, you agree to pay all applicable fees. Subscription fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law.

5.2 Payment Processing

All payments are processed securely through Stripe. We do not store your full credit card information. You authorize us to charge your payment method for all fees incurred.

5.3 Transaction Fees

For guest purchases made through the Platform (upsells, add-ons), we charge a transaction fee. The current fee structure is available on our pricing page. We reserve the right to modify fees with 30 days' notice.

5.4 Refunds and Cancellations

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds will be provided for partial subscription periods unless required by law.

6. Intellectual Property Rights

6.1 Our Rights

The Platform, including all content, features, and functionality, is owned by GuestGuide and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6.2 Your Content

You retain ownership of all content you create on the Platform. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content solely for the purpose of providing and improving our services.

7. Disclaimers and Limitations of Liability

7.1 Service "As Is"

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUESTGUIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless GuestGuide and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Conduct that harms other users or the Platform

Upon termination, your right to use the Platform will immediately cease. We may delete your account and content, but we are not obligated to do so.

10. Dispute Resolution and Governing Law

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

10.2 Arbitration
